Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and InsuranceLeads4u ("Company," "we," "us," or "our") governing your access to and use of the InsuranceLeads4u website located at insuranceleads4u.com and all related subscription services (collectively, the "Service").

By creating an account, subscribing to any plan, or otherwise accessing the Service, you represent that you are at least eighteen (18) years of age, have the legal authority to enter into this agreement, and agree to be bound by these Terms in their entirety. If you are entering into these Terms on behalf of a business entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must immediately cease use of the Service.

2. Description of Service

InsuranceLeads4u provides a subscription-based platform that gives licensed insurance professionals access to insurance lead data for outbound sales and marketing purposes. The Service includes:

• Access to a database of insurance lead records filterable by state, zip code, age range, and insurance type
• Monthly lead credits redeemable for CSV file downloads
• Raw lead lists and DNC-scrubbed lead lists, depending on your subscription plan
• Dashboard tools for managing credits, filters, and download history

The Service is intended exclusively for licensed insurance agents, brokers, and agencies engaged in lawful insurance outreach activities. Use of the Service for any other purpose is strictly prohibited.

3. Account Registration and Security

To access the Service, you must create an account and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Promptly notifying us of any unauthorized use of your account
• Ensuring your account information remains accurate and up to date

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity. You may not share your account credentials with third parties or allow multiple users to access the Service under a single account.

4. Subscription Plans and Billing

4.1 Subscription Terms

InsuranceLeads4u offers monthly subscription plans that provide a fixed number of lead credits per billing period. Subscriptions are billed on a recurring monthly basis and automatically renew at the end of each billing period unless canceled. Lead credits are allocated at the start of each billing period and expire at the end of that period — unused credits do not roll over.

4.2 Payment Processing

All payments are processed by Stripe, Inc., a PCI-DSS Level 1 compliant payment processor. By providing payment information, you authorize us to charge your payment method on a recurring monthly basis for the subscription fee applicable to your selected plan. You represent that you are authorized to use the payment method provided. We do not store your full payment card details on our servers.

4.3 Price Changes

We reserve the right to modify subscription pricing at any time. We will provide at least thirty (30) days' advance notice of any price changes via email to the address associated with your account. Your continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.

4.4 Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service and any remaining lead credits through the end of the paid period. We do not provide prorated refunds for partial billing periods.

5. Refund Policy

Due to the digital nature of our Service and the immediate delivery of lead data upon download, all sales are final. We do not offer refunds on subscription fees or downloaded lead credits under any circumstances, except as follows:

• If you experience a verified technical failure that prevents you from accessing your purchased credits, contact us within twenty-four (24) hours of the issue and we will investigate and remedy the situation.
• If you are charged in error due to a billing system malfunction, we will issue a full refund of the erroneous charge.

Dissatisfaction with lead quality, contact rates, or conversion results does not constitute grounds for a refund. Lead data is provided on an "as is" basis, and results depend entirely on your dialing activity, follow-up consistency, and sales process.

6. Acceptable Use and Compliance Obligations

Your use of lead data obtained through the Service is subject to strict compliance requirements. By subscribing to and using the Service, you represent, warrant, and agree that:

6.1 Lawful Use Only

• You will use lead data exclusively for lawful insurance outreach purposes in connection with your licensed insurance business.
• You will not use lead data for spam, harassment, deceptive practices, or any purpose prohibited by applicable law.
• You will not use lead data to contact individuals who have previously requested to be placed on your internal Do Not Call list.

6.2 Telemarketing Compliance

You are solely responsible for complying with all federal and state telemarketing laws and regulations, including but not limited to:

• The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227
• The FTC Telemarketing Sales Rule (TSR), 16 C.F.R. Part 310
• The National Do Not Call Registry regulations
• All applicable state telemarketing, auto-dialer, and consumer protection statutes

While our DNC Scrubbed plans are run against the National Do Not Call Registry at the time of data preparation, DNC status can change daily. You remain solely responsible for scrubbing your lists against the current National DNC Registry and any applicable state DNC registries before each calling campaign. We make no warranty that DNC Scrubbed lists are current or complete at the time of your use.

6.3 Prohibited Uses

You expressly agree not to:

• Resell, sublicense, redistribute, or share lead data with any third party
• Use lead data for any purpose other than your own licensed insurance outreach
• Reverse engineer, scrape, or attempt to extract our underlying database
• Use automated tools to access the Service beyond normal use
• Attempt to circumvent any security or access controls
• Use the Service to engage in any fraudulent, deceptive, or unlawful activity

7. Data Quality Disclaimer

Lead data provided through the Service consists of aged consumer contact information sourced from a large rotating database. You acknowledge and understand that:

• Lead data is not real-time or freshly generated — it is aged cold data requiring high-volume dialing and persistent follow-up to produce results.
• We do not guarantee the accuracy, completeness, or currentness of any lead record, including phone numbers, addresses, or demographic information.
• Contact rates, conversion rates, and sales results vary significantly based on your dialing activity, follow-up frequency, sales skills, and market conditions.
• We make no representations or warranties regarding the fitness of lead data for any particular purpose or the results you may achieve.

The Service is designed for insurance professionals who understand that cold data outreach is a volume-based activity requiring consistent daily effort. If you are not prepared to dial at high volume with persistent follow-up, this Service may not be appropriate for your business model.

8. Intellectual Property and Proprietary Rights

8.1 Ownership

All content, software, source code, object code, algorithms, data structures, technology, trade secrets, business processes, and materials comprising the Service — including but not limited to the website design, platform architecture, filtering algorithms, lead scoring systems, data aggregation methods, user interface designs, graphics, logos, trademarks, service marks, and all associated documentation — are the exclusive intellectual property of InsuranceLeads4u, LLC and are protected by United States copyright law (17 U.S.C. § 101 et seq.), trademark law (15 U.S.C. § 1051 et seq.), trade secret law (18 U.S.C. § 1836 et seq.), and applicable international intellectual property treaties.

8.2 Limited License

Your subscription grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for its intended purpose during your active subscription period. This license does not include the right to copy, reproduce, modify, adapt, translate, distribute, transmit, display, perform, sell, sublicense, or create derivative works from any part of the Service, its source code, or its underlying technology. All rights not expressly granted herein are reserved by InsuranceLeads4u.

8.3 Copyright Notice

Unauthorized reproduction, distribution, or creation of derivative works is strictly prohibited and may result in civil and criminal penalties under 17 U.S.C. § 504 and 17 U.S.C. § 506, including statutory damages of up to $150,000 per infringement.

8.4 Trademark Notice

"InsuranceLeads4u," the InsuranceLeads4u logo, "Raw Data. Real Results.," and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of InsuranceLeads4u, LLC. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

9. Anti-Scraping, Anti-Copying, and Technical Restrictions

9.1 Prohibited Technical Activities

You expressly agree that you will not, and will not permit any third party to:

• Use any automated tool, bot, spider, crawler, scraper, data mining software, or similar technology to access, index, harvest, collect, or extract any data, content, or information from the Service
• Copy, reproduce, mirror, frame, or create any derivative version of the Service's website, user interface, design, layout, or functionality
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data structures, or trade secrets of the Service
• Circumvent, disable, or interfere with any security features, access controls, rate limiting, authentication mechanisms, or technical protection measures of the Service
• Access the Service through any means other than the interfaces expressly provided by InsuranceLeads4u
• Use the Service's API endpoints for any purpose other than their intended functionality within the normal operation of the Service
• Create a competing product or service that replicates the functionality, design, or user experience of the Service
• Systematically download, store, or cache content from the Service beyond what is necessary for normal individual use

9.2 Monitoring and Enforcement

We actively monitor the Service for unauthorized access, scraping, and copying activities using technical measures including but not limited to rate limiting, bot detection, behavioral analysis, and access logging. Any violation of this section may result in immediate account termination, permanent IP blocking, and pursuit of all available legal remedies, including injunctive relief and damages.

9.3 Liquidated Damages

You acknowledge that unauthorized scraping, copying, or reproduction of the Service causes harm that is difficult to quantify. Accordingly, you agree that in addition to any other remedies available at law or in equity, InsuranceLeads4u shall be entitled to liquidated damages of $25,000 per incident of unauthorized scraping, copying, or reproduction, plus all costs and attorneys' fees incurred in enforcement.

10. DMCA Notice and Takedown Procedure

InsuranceLeads4u respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond promptly to notices of alleged copyright infringement that comply with the DMCA.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide our designated copyright agent with the following information:

• A physical or electronic signature of the person authorized to act on behalf of the copyright owner
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing, with sufficient detail to locate it
• Your contact information (address, telephone number, and email address)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner

11. Trade Secrets and Confidential Information

You acknowledge that the Service contains valuable trade secrets and confidential information of InsuranceLeads4u, including but not limited to:

• Proprietary data aggregation, filtering, and scoring algorithms
• Lead database architecture and data sourcing methodologies
• Business processes, pricing models, and customer acquisition strategies
• Software architecture, API designs, and system configurations
• Vendor relationships, data partnerships, and supplier agreements

You agree to maintain the confidentiality of all trade secrets and confidential information you may access or become aware of through your use of the Service. This obligation survives the termination of your account and these Terms. Misappropriation of trade secrets may result in civil liability under the Defend Trade Secrets Act (18 U.S.C. § 1836) and applicable state trade secret laws, including injunctive relief, actual damages, and exemplary damages up to two times the amount of actual damages for willful and malicious misappropriation.

12. Indemnification

You agree to indemnify, defend, and hold harmless InsuranceLeads4u, its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service or any lead data obtained through the Service; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party right, including telemarketing laws; or (d) any claim by a consumer arising from your outreach activities using lead data from the Service.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSURANCELEADS4U SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

14. Disclaimer of Warranties

THE SERVICE AND ALL LEAD DATA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

15. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any of the following reasons:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent, deceptive, or illegal activity
• Non-payment of subscription fees
• Actions that could harm the Service, other users, or third parties

Upon termination, your right to access the Service ceases immediately. Sections 6, 8, 9, 10, 11, 12, 13, 14, 16, and 17 of these Terms survive termination and remain in full force.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which InsuranceLeads4u is principally located, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted on an individual basis — class action arbitration is expressly waived.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide at least thirty (30) days' advance notice via email and by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must cancel your subscription and discontinue use of the Service before the effective date.

18. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and InsuranceLeads4u regarding the Service and supersede all prior agreements, representations, and understandings.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
